Terms of service
1. SCOPE
These General Terms and Conditions (hereinafter “Terms”) of SMN Online Distribution, Russikerstrasse 23, 8330 Pfäffikon ZH, Switzerland (hereinafter “Seller”) apply to all contracts that a consumer or business (hereinafter “Customer”) concludes with the Seller for the goods presented in the online shop daumendreher.shop. The Customer’s own terms only apply if the Seller expressly agrees to them.
A consumer within the meaning of these Terms is any natural person ordering mainly for private use. A business within the meaning of these Terms is anyone ordering for a professional or commercial activity, for example a gym, a club or a company.
2. CONCLUSION OF CONTRACT
The product presentations in the online shop are not binding offers by the Seller but an invitation to the Customer to place an order.
The Customer adds the desired goods to the cart, goes through checkout and, by clicking the button that completes the order, makes a binding offer for the goods in the cart. Before the order is submitted, all details are shown once more and can be corrected.
The contract is concluded when the Seller confirms the order by email or delivers the goods, whichever happens first.
For orders based on an individual quote or invoice, for example for gyms and clubs, the conditions stated there apply in addition.
The Seller stores the contract text and sends the order details to the Customer by email. Customers with a customer account can view their orders there at any time.
Order processing and contact usually take place by email. The Customer ensures that the email address provided is correct and that emails from the Seller and from third parties commissioned by the Seller are not held back by a spam filter.
3. SATISFACTION GUARANTEE AND RETURNS
There is no statutory right of withdrawal. The Seller voluntarily grants a satisfaction guarantee: if the Customer is not satisfied with the tape, they email tapes@daumendreher.shop with their order number within 30 days of receipt. The Seller then refunds the purchase price of the entire order; the Customer does not have to send anything back.
The Customer may also return unopened, shrink-wrapped rolls within 30 days of receipt.
Sample orders are excluded from the satisfaction guarantee. Details are set out in the refund policy.
4. PRICES AND PAYMENT
All prices are final prices in Swiss francs (CHF). The Seller is not registered for value added tax; no VAT is shown. Shipping costs are displayed in the cart and before the order is completed.
The available payment methods are displayed at checkout.
If the Customer chooses “PayPal”, payment is processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal user agreement available at https://www.paypal.com/ch/legalhub/paypal/useragreement-full. This requires, among other things, that the Customer opens a PayPal account or already has one.
5. DELIVERY AND SHIPPING
The Seller only delivers to Switzerland and Liechtenstein, by shipping to the delivery address provided by the Customer. The delivery address entered at checkout is decisive. If PayPal is used, the delivery address stored with PayPal at the time of payment is decisive instead.
If the carrier returns the goods to the Seller because they could not be delivered, the Customer bears the costs of the unsuccessful shipment. This does not apply if the Customer is not responsible for the reason or was temporarily unable to accept delivery, unless the Seller had announced the delivery a reasonable time in advance.
Collection in person is not possible for logistical reasons.

6. RETENTION OF TITLE
If the Seller delivers before payment, the Seller retains title to the goods delivered until the purchase price has been paid in full.
7. WARRANTY
If the goods are defective, the statutory provisions of the Swiss Code of Obligations apply.
The Customer is asked to report goods with obvious transport damage to the carrier and to inform the Seller. Failure to do so has no effect on the Customer’s statutory or contractual claims.
8. REDEEMING PROMOTIONAL VOUCHERS
Vouchers and discount codes that the Seller issues free of charge as part of promotions with a limited period of validity and that cannot be purchased (hereinafter “Promotional Vouchers”) can only be redeemed in the Seller’s online shop and only within the stated period.
Promotional Vouchers can only be redeemed by consumers.
Individual products may be excluded from the promotion if the conditions of the Promotional Voucher say so.
Promotional Vouchers can only be redeemed before the order is completed. They cannot be applied afterwards.
Only one Promotional Voucher can be redeemed per order.
The value of the goods must be at least the amount of the Promotional Voucher. Any remaining balance will not be refunded.
If the value of the Promotional Voucher does not cover the order, the Customer can pay the difference with one of the other payment methods offered.
The balance of a Promotional Voucher is neither paid out in cash nor does it bear interest.
If an order paid wholly or partly with a Promotional Voucher is refunded, the value of the Promotional Voucher is not refunded.
9. APPLICABLE LAW AND JURISDICTION
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that it does not deprive them of the protection of mandatory provisions of the law of their habitual residence.
If the Customer is a business, the place of jurisdiction is the Seller’s registered office in Pfäffikon ZH. For consumers, the statutory places of jurisdiction apply.
10. LANGUAGE
These Terms are available in German and English. In the event of any discrepancy, the German version prevails.
